These Terms and Conditions (“Terms”) govern your use of MarsResearch.com and the websites, portals, accounts, research participation services, client services, communications, and other services provided by Mars Research, Inc. (“Mars Research,” “we,” “us,” or “our”).

By accessing or using MarsResearch.com, creating an account, registering for our research panel, completing a research screener, participating in a research study, using a client portal, or otherwise using our services, you agree to these Terms.

If you do not agree with these Terms, you should not use the website or related services.

1. About Mars Research

Mars Research, Inc. is a marketing research company that conducts qualitative and quantitative market research on behalf of its clients.

Our research activities may include surveys, focus groups, individual interviews, product tests, taste tests, usability studies, central location tests, online research, telephone research, and other forms of market research.

Mars Research may communicate with research participants and potential participants by email, telephone, SMS/text message, online platforms, and other methods.

2. Use of the Website

You agree to use MarsResearch.com and our services only for lawful purposes and in accordance with these Terms.

You may not:

  • Provide false, misleading, fraudulent, or intentionally inaccurate information;

  • Impersonate another individual;

  • Create duplicate or fraudulent accounts;

  • Attempt to participate in the same study more than once unless expressly authorized;

  • Use automated systems, bots, scripts, or other deceptive methods to complete surveys or research activities;

  • Attempt to gain unauthorized access to any account, client portal, database, system, or information;

  • Interfere with the security or operation of the website or our systems;

  • Copy, distribute, publish, record, or disclose confidential research materials without authorization; or

  • Use information obtained through Mars Research for an unlawful or unauthorized purpose.

We may restrict, suspend, or terminate access to our website, panel, studies, accounts, or services if we reasonably believe these Terms have been violated.

3. Research Panel and Respondent Accounts

Individuals may have the opportunity to register with Mars Research, create a respondent profile, join a research panel, or provide information for consideration for future research opportunities.

Registration with Mars Research does not guarantee that you will be invited to, qualify for, or participate in any research study.

Research opportunities depend on the specific qualifications and requirements established for each project.

You are responsible for providing accurate and current information and, where applicable, maintaining the confidentiality of your account credentials.

You should notify Mars Research if you believe your account has been accessed or used without authorization.

4. Research Invitations and Screening

Mars Research may invite individuals to participate in research studies based on information contained in their profile, information previously provided to Mars Research, client requirements, or other research criteria.

Receiving an invitation to a study, completing a screening questionnaire, or being contacted by Mars Research does not guarantee that you will qualify for or be selected to participate in the study.

Research studies may have specific eligibility requirements based on characteristics such as age, location, occupation, purchasing behavior, product usage, professional experience, or other characteristics relevant to the research.

Mars Research may verify eligibility before or during a study and may terminate participation if eligibility requirements are not satisfied.

5. Accuracy of Respondent Information

Research participants are expected to provide truthful, accurate, and complete information.

Mars Research may disqualify a person from a research study, remove a person from its research panel, suspend an account, or deny an incentive if Mars Research reasonably determines that the individual has:

  • Provided materially false or misleading information;

  • Misrepresented their identity or qualifications;

  • Created duplicate accounts;

  • Attempted to participate in a study more than once without authorization;

  • Used automated or fraudulent methods to complete a study;

  • Failed reasonable research quality or validation procedures;

  • Violated study instructions;

  • Disclosed confidential study information; or

  • Otherwise engaged in conduct that could compromise the integrity of the research.

6. Research Incentives and Payments

Some research studies offer incentives or compensation for participation.

The amount, type, timing, and eligibility requirements for an incentive may vary by study.

An invitation to participate, completion of a screener, or selection for further screening does not by itself create a right to receive an incentive.

To receive an incentive, participants may be required to:

  • Qualify for the research;

  • Attend or participate at the scheduled time;

  • Complete the required research activities;

  • Follow study instructions;

  • Provide genuine and thoughtful responses; and

  • Satisfy other requirements disclosed for the particular study.

Mars Research may withhold or reverse an incentive where it reasonably determines that there has been fraud, duplicate participation, material misrepresentation, or failure to satisfy disclosed study requirements.

7. Minors Participating in Research

Mars Research may conduct certain research studies involving children or minors.

When required by applicable law, research standards, or study requirements, participation by a minor will require permission or consent from a parent or legal guardian.

Mars Research may also request age-appropriate assent from the minor.

Additional consent forms or study-specific requirements may apply to research involving minors.

A parent or guardian who provides information or consent on behalf of a minor represents that they have authority to do so.

8. Audio Recording, Video Recording and Observation

Certain research activities may be observed, audio recorded, video recorded, photographed, livestreamed, or otherwise documented.

Research may also be conducted through third-party communication platforms such as Zoom, Microsoft Teams, or similar services.

Clients of Mars Research, their representatives, moderators, researchers, or other authorized individuals may observe certain research sessions either in person or remotely.

Where appropriate or required, Mars Research will provide additional disclosures or obtain additional consent related to recording, observation, photography, or other study-specific activities.

Participation in a study requiring recording or observation may be conditioned upon providing the applicable consent.

9. Confidential Research Materials

During a research study, participants may be exposed to confidential or proprietary information belonging to Mars Research or one of its clients.

This information may include, without limitation:

  • Products that have not yet been released;

  • Product concepts;

  • Prototypes;

  • Packaging;

  • Advertising;

  • Marketing concepts;

  • Business concepts;

  • Software;

  • Websites or applications;

  • Product designs;

  • Pricing;

  • Research findings;

  • Written materials;

  • Photographs;

  • Videos; or

  • Other confidential or proprietary information.

Unless expressly authorized, participants may not photograph, screenshot, record, copy, reproduce, download, distribute, publish, post on social media, discuss publicly, or otherwise disclose confidential research materials.

Participants may be required to execute a separate confidentiality agreement or nondisclosure agreement for a particular research study.

If a study-specific confidentiality agreement contains requirements that are more specific or restrictive than these Terms, the study-specific agreement will govern with respect to that study.

10. Email Communications

By providing an email address to Mars Research, you may receive communications related to:

  • Research study invitations;

  • Screening opportunities;

  • Appointment confirmations;

  • Appointment reminders;

  • Scheduling or rescheduling;

  • Cancellations;

  • Follow-up communications;

  • Research panel communications;

  • Account-related communications; and

  • Other communications associated with Mars Research services.

Where applicable, emails will include instructions for opting out of future promotional or research invitation emails.

You may use the unsubscribe or opt-out mechanism contained in the email to stop receiving applicable email communications.

Certain administrative, security, account-related, or other communications may still be sent when necessary to administer an existing relationship or transaction, subject to applicable law.

11. SMS/Text Messaging Terms

Mars Research offers an optional SMS/text messaging program.

By opting in to Mars Research SMS messaging, you authorize Mars Research to send periodic text messages to the mobile telephone number you provide, including messages sent using automated technology.

Messages may include:

  • Research study invitations;

  • Screening opportunities;

  • Appointment confirmations;

  • Appointment reminders;

  • Scheduling and rescheduling information;

  • Cancellation notices;

  • Follow-up communications; and

  • Other communications related to Mars Research studies and services.

Message frequency varies.

Message and data rates may apply.

Your consent to receive SMS messages is voluntary, and you may withdraw your consent at any time.

SMS Opt-Out

You may opt out of SMS messages at any time by replying:

After requesting to opt out, you may receive a final confirmation message acknowledging your request.

You may also contact Mars Research at 954-771-7725 or recruiting@marsresearch.com to request that SMS communications be stopped.

Mars Research will process opt-out and consent-revocation requests in accordance with applicable law.

After opting out, you may opt in again in the future by completing an applicable SMS consent process.

Delivery of text messages is subject to the availability and operation of wireless networks and telecommunications providers and cannot be guaranteed.

12. Client Accounts and Client Portal

Mars Research clients may be provided access to password-protected client portals, reports, research data, project information, files, recordings, or other information associated with their projects.

Clients and authorized users are responsible for maintaining the confidentiality and security of their login credentials.

Client users may access only information and projects they are authorized to access.

Clients may not attempt to access another client’s project, data, account, files, or other information.

Mars Research may suspend or terminate client portal access when reasonably necessary to protect the security of our systems, client information, research participants, or other users.

Client use of Mars Research services may also be governed by proposals, statements of work, master service agreements, nondisclosure agreements, or other written agreements.

If there is a conflict between these Terms and a separately executed written agreement between Mars Research and a client, the separately executed agreement will control with respect to the subject matter of that agreement.

13. Privacy

Your privacy is important to Mars Research.

Our collection, use, storage, and disclosure of personal information is described in the Mars Research Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

14. Intellectual Property

Unless otherwise stated, the MarsResearch.com website and its content, including text, graphics, logos, software, design elements, surveys, questionnaires, and other materials created by Mars Research are owned by or licensed to Mars Research and are protected by applicable intellectual property laws.

Materials belonging to Mars Research clients remain the property of those clients or their respective owners.

Nothing in these Terms grants you ownership of any Mars Research or client intellectual property.

You may not reproduce, distribute, modify, publish, sell, license, reverse engineer, or commercially exploit protected materials without appropriate authorization.

15. Third-Party Services and Links

Mars Research may use or provide access to third-party platforms, software, websites, payment services, survey platforms, video conferencing systems, telecommunications providers, or other services.

Your use of third-party services may also be subject to the third party’s terms and privacy policies.

Mars Research is not responsible for the availability, operation, security, or content of third-party services except to the extent required by applicable law or contractual obligations.

16. Website Availability

Mars Research attempts to maintain reliable website and portal services but does not guarantee uninterrupted or error-free access.

Services may occasionally be unavailable due to maintenance, technical problems, telecommunications failures, cybersecurity measures, third-party service disruptions, or circumstances outside our reasonable control.

Mars Research may modify, suspend, discontinue, or update portions of its website or services when reasonably necessary.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, MarsResearch.com and related online services are provided on an “as is” and “as available” basis.

Mars Research makes no guarantee that:

  • You will qualify for a research study;

  • You will receive a particular number of study invitations;

  • A particular research opportunity will remain available;

  • The website or client portal will always be available without interruption; or

  • Every communication will be successfully delivered.

Nothing in these Terms excludes any warranty, right, or protection that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Mars Research, its officers, employees, representatives, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of or inability to use MarsResearch.com or related services.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

19. Suspension and Termination

Mars Research may suspend or terminate access to an account, panel membership, research opportunity, or online service when reasonably necessary because of:

  • Fraud or suspected fraud;

  • Materially inaccurate information;

  • Duplicate accounts;

  • Unauthorized access;

  • Security concerns;

  • Misuse of the website or client portal;

  • Violation of confidentiality obligations;

  • Violation of study instructions;

  • Violation of these Terms; or

  • Conduct that threatens the integrity of a research project or Mars Research systems.

Termination of access does not eliminate obligations that by their nature should continue after termination, including confidentiality and intellectual property obligations.

20. Changes to These Terms

Mars Research may update these Terms periodically to reflect changes to our services, business practices, technologies, or legal requirements.

When material changes are made, the updated Terms will be posted on MarsResearch.com with a revised effective or “Last Updated” date.

Your continued use of the website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

21. Governing Law and Venue

These Terms will be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent a dispute relating to these Terms or MarsResearch.com is properly brought in court, the parties agree that the appropriate state or federal courts located in or serving Broward County, Florida will have jurisdiction and venue, except where applicable law requires otherwise.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable when possible.

The remaining provisions will continue in full force and effect.

23. No Waiver

Failure by Mars Research to enforce a provision of these Terms does not constitute a waiver of that provision or of the right to enforce it later.

24. Entire Agreement

These Terms, together with the Mars Research Privacy Policy and any applicable study-specific consent forms, confidentiality agreements, client agreements, statements of work, or other agreements, constitute the applicable agreement between you and Mars Research regarding the services covered by those documents.

Where a separately signed agreement governs a particular research project, client relationship, or service, that agreement will control in the event of a conflict with these Terms concerning that subject matter.
